REPORT AND RECOMMENDATION RE: 9 & 18 .It is respectfully RECOMMENDED that the motion to dismiss, ECF No. 9 , filed by Wendys International, LLC, and the motion to dismiss, ECF No. 18 , filed by Wen South, LLC, be GRANTED because Plaintiff failed to exhaust administrative remedies as to the Title VII and FCRA claims and the complaint otherwise failed to state a claim upon which relief may be granted. It is also RECOMMENDED that the complaint be DISMISSED as to the individual Defendants, Green, Ross, Tarver, and Tuller, because Plaintiff has failed to prosecute and respond to Court orders providing information as to service and has failed to serve those Defendants.
