ORDER re: 104 105 "Motions for Leave to File Responses to Sur-Replies" and {106] 107 "Responses to Motions for Leave to File Responses to Sur-Replies." The court has all the briefing it needs at this time. In this light, the Motions for Leave at Docket Nos. 104 and 105 are denied. Nevertheless, it did not escape the court's notice that defendants' "Motions for Leave" are so argumentative as to be themselves de-facto unauthorized sur-sur-replies. And it is similar as to plaintiff's responses which are effectively sur-sur-sur-replies (Docket Nos. 106-107). While the court understands the parties' zealousness to get the last word in, that is not an excuse to game Local Rule 7(d). The court would be well within its discretion to order all four filings struck from the record. However, it will be generous and deem them noted instead. No further briefing on this matter will be accepted without a prior specific court request therefor, with the only exception of a notice of binding intervening authority. Signed by Judge Pedro A. (IN CHAMBERS) ORDER REQUIRING SUPPLEMENTAL AUTHORITY by Judge Mark C. Scarsi: Defendant United States of America moves to dismiss the first amended complaint of Plaintiff TruConnect Communications, Inc. (Mot., ECF No. 24 .) The Court heard argument on the motion on August 3, 2026, and took the matter under submission. (Mins., ECF No. 29 .) At the hearing on the motion, counsel for Plaintiff indicated that she is aware of a pending state court action that concerns issues similar to those raised in this action. Counsel for Plaintiff shall file a notice of supplemental authority identifying the name, docket number, and court in which the state court action is pending within seven days of entry of this Order. The Court will not consider any further argument concerning the pending motion or discussion of the authority. See, e.g., Alfred v. Walt Disney Co., No. CV 18-8074-CBM-(ASx), 2021 U.S. Dist. LEXIS 253299, at *2 (C.D. Cal. Dec. 16, 2021) (granting leave to file supplemental authority but declining to consider parties' discussion of the authority). (es)
