MINUTE entry before the Honorable Matthew F. Kennelly: Motions to file under seal 355 393 are granted; redacted versions are to be filed in the public record unless this has already been done. Response to motion for turnover order as to Peter Alexopoulos's account at Busey Bank and to extend the citation lien 394 is to be filed by 5/10/2024; reply to response is to be filed by 5/17/2024. Telephonic hearing is set for 5/23/2024 at 9:05 AM, using call-in number 888-684-8852, access code 746-1053. The citation lien relating to that account is extended on an interim basis through 5/28/2024 to enable the motion for turnover order to be briefed and the Court to rule on it is granted. In addition, defendant Tsaparas and citation respondents McFadden/eDropOff Chicago, LLC have filed a motion to stay the effect of the Court's April 24 order granting motions for turnover order relating to them. The Court advises that the initial order entered on the docket as dkt. no. 388 was a preliminary draft prepared by the clerk that was entered without authorization, as the Court had edited the draft and had sent the clerk the order actually entered as dkt. no. 389. The Court clearly and unquestionably overruled defendant's and respondents' objections to the the motions for turnover order and granted those motions during the hearing on 4/23/2024, as moving counsel will see from the transcript once they get it. However, as made clear in the written order (dkt. no. 389), the Court has not actually ordered any specific relief at this point aside from the extension of the pertinent citations. The Court is awaiting doing so, with regard to the motion concerning defendant Tsaparas, until its consideration of the additional filings required by the order and consideration of the draft order that the Court directed the parties to submit. With regard to the motion concerning McFadden/eDropOff Chicago, LLC, the Court is awaiting determination regarding how to proceed with respect to ordering relief given plaintiff's expressed intention to pursue a claim of fraudulent transfer. Thus at this point there is no specific relief that the Court has ordered that needs to be or is appropriately, stayed, and there is no question that the written order (dkt. no. 389) correctly summarizes the Court's oral determinations at the 4/23/2024 hearing.
