Minute entry for INITIAL CONFERENCE before Judge Charles Eskridge on July 7, 2026. All parties present and represented by counsel. The Court addressed the scheduling and docket control order and the joint discovery/case management plan. Dkts 7 & 14. The Court addressed the motion to dismiss by Defendant MVP Terminalling, LLC. Dkt 12. The parties advised that the related action was transferred and is now pending before Judge Alfred Bennett. See Valero Marketing & Supply Company v MVP Terminalling, LLC, 4:26-cv-02150. The parties also agreed that the claims in this action are, in substance, crossclaims that can be asserted in the Valero action. Plaintiff expressed concern that dismissal of this action without prejudice in favor of the Valero action might result in disputed contention as to whether its claims asserted in this action were somehow time-barred. Upon inquiry, Defendant stipulated that it wouldnt object to Plaintiff asserting the present claims as crossclaims in the Valero action. Plaintiff also advised that it is a Singaporean corporation, hasn't waived service, and so hasn't yet been formally served and appeared in the Valero action. The undersigned expressed the view that the present motion to dismiss would be granted, but that such disposition should await service and appearance by Plaintiff in the Valero action. The motion to dismiss by Defendant MVP Terminalling, LLC was thus HELD IN ABEYANCE. Dkt 12. This action was STAYED and deadlines were CANCELED pending service of Plaintiff in the Valero action. The parties were ORDERED to file a status report by August 21, 2026, regarding service of Plaintiff in the Valero action. If Plaintiff hasnt by then been served, the parties were ORDERED to file additional status reports on October 7th, January 7th, April 7th, and July 7th until service is made. Appearances: Mark A.
