JOINT STIPULATION AND ORDER: IT IS HEREBY STIPULATED, by and between the undersigned counsel for the parties that: 1. Defendant withdraws its pending Motion to Dismiss (ECF No. 9) without prejudice; 2. Plaintiff will file her First Amended Complaint by May 29, 2026; 3. If Plaintiff does not file an amended complaint by May 29, 2026, the action will be deemed voluntarily dismissed without prejudice under Fed. R. Civ. P. 41(a)(1)(A)(ii); 4. Defendant will respond to Plaintiffs First Amended Complaint by June 29, 2026; 5. If Defendant moves to dismiss the First Amended Complaint, Plaintiff will file an opposition by July 20, 2026, and Defendant will file a reply by August 3, 2026. Accordingly, the parties respectfully request that the Court continue the Initial Case Management Conference Order (ECF No. 11), and any related deadlines, to September 2026. Application GRANTED. The initial case management conference scheduled for June 11,2026 is canceled, as well as related deadlines. The Parties' proposed schedule for the filing of the Amended Complaint, Defendant's response, and any subsequent briefing is SO ORDERED. The Clerk of Court is respectfully requested toterminate ECF 14. SO ORDERED.
