Order on Motion for Temporary Restraining Order
ENDORSED ORDER denying without prejudice Plaintiff's request for a temporary restraining order (TRO), (see Dkt. 12), because it does not comply with Rule 65 of the Federal Rules of Civil Procedure or Rule 1.06 of the Local Rules. For example, under Rule 65, parties seeking a TRO must file a verified complaint or an affidavit, supported by specific factual allegations, showing they will suffer "immediate and irreparable injury, loss, or damage" if the court waits to grant relief. Fed. R. Civ. P. 65 (b)(1)(A). Plaintiff's request for relief does not meet these requirements. (See Dkt. 12.) Additionally, under this court's local rules, requests for a TRO must include a legal memorandum showing--through citations to legal and factual sources--that the party seeking relief is likely to prevail on the merits. See Local Rule 6.01 (b)(1). Plaintiff's motion does not include this memorandum. Because his request for relief has been denied without prejudice, Plaintiff may try again.
