Order To Show Cause
ORDER TO SHOW CAUSE - Given the Court's rulings in it Order on Zayo's Motion for Partial Summary Judgment, the Court ORDERS Zayo to SHOW CAUSE by May 29, 2024 why the third party claims associated with CSXT's claims that have either been dismissed or for which Zayo has been granted summary judgment should not be dismissed as moot. Zayo must specifically explain how the Court's rulings on its Motion for Partial Summary Judgment impact its claims against each third party defendant. To the extent a Third Party Defendant has moved for summary judgment on Zayo's third party claims, it is ORDERED to file a response to Zayo's filing by June 5, 2024, stating whether its Motion for Summary Judgment should remain pending in light of Zayo's response to the Order to Show Cause.
