Order on Motion for Reconsideration
ORDER This Order Relates to: ALL CASES. The Court denies New Mexico's motion as to reconsideration as it has not shown a clear error of law. The Court, however, clarifies its ruling as follows. The Court clarifies that discovery may continue relating to CERCLA claims. See (Dkt. No. 9329 -1 at 4-5 in case 2:18-mn-02873-RMG; (144) in case 2:20-cv-02115-RMG). Further, the prior Order's statement that the Court would not entertain "dispositive motions related to CERCLA" means it will not entertain motions for summary judgment or under Daubert at this time. AND IT IS SO ORDERED. Signed by Honorable Richard M Gergel on 8/26/2026.Associated Cases: 2:18-mn-02873-RMG, 2:20-cv-02115-RMG(sshe, )
