Order [non-document]: On 11/18/2024, Plaintiff Northwestern Ohio Administrators, Inc. moved to amend the complaint to add a second defendant, Heartland Construction & Roofing. The motion was granted on 11/22/2024, and both defendants have appeared. (Docs. 15 , 16 (Defendants' corporate disclosures); Doc. 23 (Rule 26(f) Report); 10/16/2025 Docket Entry (Minutes of Proceedings for Show Cause Hearing)). On 9/16/2026, Plaintiff moved, pursuant to Rule 41(a)(2), to dismiss only one defendant. (Doc. 35 .) Rule 21 is the proper Rule for dismissal of only a portion of the action, such as one defendant. Fed. R. Civ. P. 21 ("On motion..., the court may at any time, on just terms, add or drop a party."). If Plaintiff seeks to dismiss the entirety of the action as stated in its motion to dismiss (Doc. 35 ), an amended motion indicating all claims against both defendants are dismissed without prejudice must be filed on or before 10/5/2026.
