MEMO ENDORSEMENT on re: (20 in 7:23-cv-11305-NSR) Letter, filed by Zeshaan Ahmed, Jean Charter, Dominique Durso, Adeline Pattison, Michelle Grenon, Teresa Hale, Liane Tuomala. ENDORSEMENT: The Court is in receipt of the attached Letter from Plaintiffs in Pattison, et al., dated April 15, 2024, seeking leave to file a Motion to Consolidate Cases. The Court is further in receipt of the Letter, also attached, from the parties in Taylor, et al., dated May 14, 2024 requesting that matter be stayed pending the resolution of the Pattison, et al. request to file a Motion to Consolidate Cases. Federal Rule of Civil Procedure 42(a) permits a court to consolidate matters that "involve a common question of law or fact...." Fed. R. Civ. P. 42(a). Having been advised the Defendant in both the Pattison, et al. and Taylor, et al. matters takes no position on the request, the Court waives the pre-motion conference requirement and grants the Pattison, et al. Plaintiffs leave to file a proposed Order of Consolidation that shall include the captions and docket numbers for both the Pattison, et al. and Taylor, et al. matters, as well as a date certain for Plaintiffs to file a Consolidated Amended Class Action Complaint. Plaintiffs are to file such proposed Order of Consolidation on or before May 21, 2024. After filing the proposed Order of Consolidation, the parties are further directed to submit to the Court a proposed motion schedule with dates certain. The Court notes that it adheres to the bundling rule with respect to most motions which provides that all motion papers are to filed on the designated reply day. Taylor, et al. v. Teladoc Health, Inc., 24-cv-664 (NSR) is hereby STAYED pending this Court's entrance of an order of consolidation. SO ORDERED. (Signed by Judge Nelson Stephen Roman on 5/17/2024) (mml)
