P. 12(b)(1) and 12(h)(3) for lack of subject matter jurisdiction. (Doc. No. 8.) The Court notes that it does not typically permit parties to file separate, successive motions to dismiss a complaint pursuant to Fed. R. Civ. P. 12(b). By no later than August 31, 2026, Defendant shall file a Notice on the docket explaining why it should be permitted to file two separate Rule 12(b) motions to dismiss the Complaint in this action, particularly when one of them (Doc.
