ORDER. The Court has reviewed Plaintiff's response to the Court's August 23, 2026 Order to Show Cause. (ECF No. 23 .) At this stage of the litigation, Plaintiff has established that this Court has subject matter jurisdiction over this action pursuant to 28 U.S.C. § 1332(a). As set forth in the Court's Order to Show Cause (ECF No. 19 ), Plaintiff has established that the amount-in-controversy requirement has been satisfied and that Defendant is a citizen of Texas. (Id. at 4.) In his response to the Order to Show Cause, Plaintiff provides a sworn affidavit with supporting documentation establishing that his residence, part-time employment, and medical and dental providers are all located in New York, that he has a New York driver's license, and that he currently attends university in New York. (See ECF Nos. 23 , 23 -1 to 23 -4.) Together, these facts are sufficient to establish that Plaintiff is presently domiciled in, and is a citizen of, New York. See Van Buskirk v. United Grp. of Cos., Inc., 935 F.3d 49, 53 (2d Cir. 2019) ("An individual's citizenship, within the meaning of the diversity statute, is determined by his domicile," or in other words, "the place where a person has his true fixed home and principal establishment, and to which, whenever he is absent, he has the intention of returning."); Lever v. Lyons, No. 16-cv-5130, 2021 WL 302648, at *7 (E.D.N.Y. Jan. 28, 2021) (holding that facts considered when determining an individual's domicile include the state of a person's residence, driver's license, place of employment, and bank accounts).Therefore, because the parties are completely diverse from one another and the amount-in-controversy requirement has been met, this Court has subject matter jurisdiction over this action pursuant to 28 U.S.C. § 1332(a).Ordered by Judge Nusrat J.
