Order [non-document]. Now pending is Plaintiffs' motion for sanctions and an adverse inference instruction against Defendants. ("Plaintiffs' Motion," ECF No. 43 ). On 9/1/2026, I issued an order stating that "[a]dditional briefing is necessary resolve Plaintiffs' Motion. Defendants are ordered to file a supplemental brief within seven days addressing, with specificity, the five issues set forth in this Order. Plaintiffs shall have three days to respond to Defendants' supplemental brief. No reply brief shall be permitted. See Order for details." (ECF No. 53 , emphasis added). To date, Defendants have failed to comply with the 9/1/2026 order to file a supplemental brief addressing the five issues set forth in the 9/1/2026 Order. Defendants are ORDERED to file a supplemental brief in compliance with the 9/1/2026 order on or before 9/15/2026. Defendants are on notice that failure to comply with this and other court orders may result in a recommendation of sanctions or other penalties.
