   TEXT ORDER (A) denying 39 Joint Motion to Continue September 1, 2026 Hearing Date, for want of good cause under Federal Rule of Civil Procedure 6(b)(1)(A), but nonetheless (B) re-setting said hearing to 2:30 p.m. on 09/17/2026 in Courtroom 1A of the L. Richardson Preyer United States Courthouse in Greensboro, North Carolina, pursuant to the Court's own authority to control its docket. In 39 Joint Motion, the parties requested a continuance of the hearing set for 09/01/2026, based on the assertion that "[n]either counsel for Plaintiff nor counsel for Defendant is available to attend the hearing on September 1, 2026." As support for that assertion, 39 Joint Motion identifies only the vacation plans of one of two attorneys of record for Defendant (which extend through 09/07/2026). That showing does not establish good cause within the meaning of Federal Rule of Civil Procedure 6(b)(1)(B), as it does not address the availability of the other counsel of record for Defendant or either counsel of record for Plaintiff. Nor does 39 Joint Motion contain any justification for the assertion that, between 09/01/2026 and 10/02/2026, only "seven dates [exist] on which counsel for both [p]arties are presently available to appear." Under these circumstances, the Court must deny 39 Joint Motion because the parties have not met their burden under the applicable rule provision. However, the Court will exercise its discretion to re-set the hearing to a date proposed by the parties. The parties should not expect similar dispositions in the future. Issued by MAG/JUDGE L.
