PAPERLESS ORDER. The Court has received an email from Plaintiff's counsel this morning indicating that Defendant may object to the mediator in this case, who is scheduled to conduct mediation tomorrow morning, and requesting an immediate telephonic hearing. To be clear, the Court has ordered (on several occasions) the mediation to go forward. No party has sought relief from the Court's orders based on any objection to the mediator. Accordingly, the Court does not intend to take any action. The Court expects the mediation to proceed as scheduled, as previously ordered. Failure by any party to attend and participate in mediation in good faith may result in the striking of pleadings, a finding of contempt, and/or other sanctions (against the parties and/or counsel).
