Order on Motion to Withdraw as Attorney
PAPERLESS ORDER granting 31 Unopposed Motion to Withdraw to Withdraw as Attorney. The law firm of Sims Betar and attorneys Maria Fuxa and Ricardo Fernandez shall be withdrawn as counsel for Defendant Provident Biscayne Resort LLC (“Provident”) in this matter.
But Provident, as a corporation, can’t proceed pro se. See Ortega v. Las Brisas Restaurante, LLC, 2015 WL 11181730, at *1 (S.D. Fla. Mar. 24, 2015) (Dimitrouleas, J.) (“Artificial entities like corporations and limited liability companies cannot appear pro se and must be represented by counsel.”) (citing Palazzo v. Gulf Oil Corp., 764 F.2d 1381, 138-86 (11th Cir. 1985)). Accordingly, we ORDER Provident to retain new counsel by August 20, 2026. In the meantime, we CLOSE and STAY this case. After Provident has retained new counsel, the parties shall submit a joint motion to reopen this case, which shall include a new proposed trial schedule. Finally, we ORDER Provident’s former counsel to provide Provident with a copy of this Order.
