For the reasons stated in the accompanying Opinion, the Court GRANTS the motion for class certification filed by the plaintiff, TVPX ARS, Inc, (ECF No. 78 ); DENIES IN PART the motion for summary judgment filed by the defendant, Genworth Life and Annuity Insurance Co., as it relates to standing, and GRANTS IN PART that motion as it relates to the merits of the breach of contract claim, (ECF No. 84 .); DENIES AS MOOT the remaining pretrial motions in the case, (ECF Nos. 112 , 114 , 121 , 123 , 125 ); and DIRECTS the Clerk to close the case.
