The Court holds today's hearing to address the status of Defendants retaining counsel as ordered by the Court. The Court inquires as to the status. Mr. Hernandez, appearing on behalf of the defendants, advises the Court that the defendants have not been able to secure counsel due to financial hardship.
Ms. Garcia-Bautista addresses the Court. Based on counsels' representations, the Court directs counsel to file a request for clerk's entry of default followed by a motion for default judgment. Defendant's request for leave to exceed page limit.
IT IS ORDERED that Jury Trial currently set for November 3, 2026, at 9:00 a.m. is VACATED.
IT IS FURTHER ORDERED that the Defendants are granted leave to file a consolidated motion for default judgment up to 35 pages in 2:23-cv-01309-ART-EJY and 2:23-cv-01310-ART-EJY.
