Electronic Clerk's Notes for proceedings held before Magistrate Judge Donald L. Cabell: Motion Hearing held on October 5, 2026 re 43 MOTION to Compel Defendant Pennsylvania Lumbermens Mutual Insurance Company's Motion to Compel.
The Court heard arguments from all parties and made the following ruling: GRANTING in part and DENYING in part 43 Motion to Compel for the reasons stated on the record. Plaintiff will produce on or before October 16, 2026 for in camera review any communications between plaintiff's counsel and Mario Dies that have been withheld under work product or attorney/client privilege. Plaintiff will issue correspondence to Defendant regarding its compliance in disclosure of any discovery related to the Town of Andover's minutes, as discussed on the record.
The Court also ORDERS that defendant be permitted to inspect the roof as soon as practical consistent with the protocols discussed on the record.
