ORDER APPROVING JOINT STIPULATION FOR RELEASE OF DEFENDANT VESSEL BARGE TIDE MAR UPON POSTING OF SUBSTITUTE SECURITY, DIRECTING RELEASE OF VESSEL, AND TAKING OFF CALENDAR MOTION FOR INTERLOCUTORY VESSEL SALE AND REPORT AND RECOMMENDATION by Judge Cynthia Valenzuela: The Joint Stipulation for Release of the Defendant Vessel Barge TIDE MAR Upon Posting of Substitute Security, and for Removal of the Vessel 56 is hereby APPROVED in its entirety. Specially Appearing Claimant Greener Port Solutions, LLC ("GPS") shall deposit the Security of $300,000.00 into the Registry of this Court pursuant to 28 U.S.C. section 2041 and Local Rule 67-1, not later than one (1) court day after entry of this Order. GPS shall file a Notice of Deposit on the same date. Upon GPS's filing of the Notice of Deposit: (a) the Security shall constitute the substitute res with the same validity, priority, and dignity as all liens and interests against the Vessel; (b) the Sale Motion 46 and the Report and Recommendation of the Magistrate Judge 52 shall be taken off calendar as moot, without prejudice; and (c) any pending hearing on the Sale Motion shall be vacated.
