Minutes of proceedings [non-document] before Chief District Judge Sara Lioi. On September 4, 2026, the Court conducted a telephonic status conference. Attorney Christopher Wick participated on behalf of Semiconductor Components Industries, LLC ("onsemi"), Attorney William Stavole participated on behalf of the Receiver, FTI Consulting, Inc., and Attorney Jeremy Campana participated on behalf of The Evergreen Advantage, LLC. Attorney Stavole represented that the issue involving the 401(k) plan had been resolved for the purposes of a settlement. But another issue had come up. Attorney Stavole had learned that Clean Harbors refuses to perform planned clean up services while certain invoices remained unpaid. The parties had yet to receive copies of the invoices. Attorney Wick represented that, if the invoices were issued to onsemi, onsemi would pay them. The Receiver and onsemi will diligently work to resolve the issue. It is possible that if Clean Harbors refuses to do the work, another service provider may need to be retained. Based on the parties' representations, the Court expects a resolution of the last remaining issue in short order and a filed Deed-in-Lieu Agreement by Wednesday, September 9. (Court Reporter: None.)
