Docket Text ORDER: IT IS ORDERED that Plaintiff's Motion to Dismiss Case Without Prejudice, Doc. 15 , is DENIED. The Court finds that dismissal of this action would not be proper under Rule 41(a)(2) and that the factors set out in Hamm v. Rhone-Poulenc Rorer Pharmaceuticals, Inc., 187 F.3d 941, 950 (8th Cir. 1999), weight against dismissal. Because the "decision whether to allow a party to voluntarily dismiss a case rests upon the sound discretion of the court," Plaintiff's Motion to Dismiss Case Without Prejudice, Doc. 15, is DENIED. Plaintiff may move to amend his Complaint if he wishes. IT IS FURTHER ORDERED that the Joint Motion to Stay Referral to Mediation, Doc. 22 , is DENIED. ADR must be completed by December 1, 2026, and the Designation of Neutral Report is due no later than October 16, 2026.
