Order on Motion for Sanctions Order on Motion to Strike
ORDER: (1) GRANTING DEFENDANTS NTKN, INC., AND HUNG KY'S MOTION FOR RULE 37 SANCTIONS RE: TRENDEX'S DISCLOSURES AND PRODUCTIONS MADE AFTER THE CLOSE OF DISCOVERY; (2) GRANTING IN PART AND DENYING IN PART DEFENDANTS NTKN, INC. AND HUNG KY'S MOTION TO STRIKE MARCH 18, 2024 EXPERT REPORT OF DEBORAH YOUNG re 180 , 181 - Signed by MAGISTRATE JUDGE KENNETH J. MANSFIELD on 5/17/2024.
Based on the foregoing, the Court GRANTS Defendants' Motion for Sanctions (ECF No. 180). Plaintiffs are precluded from introducing and relying on the documents produced in the Sixth Supplement. The Court GRANTS IN PART AND DENIES IN PART Defendants' Motion to Strike (ECF No. 181) inasmuch as (i) Plaintiffs belatedly withdrew the Surrebuttal Report; and (ii) the Court denies at this time Defendants' request to limit Ms. Young's trial testimony. Lastly, the Court will issue an award of reasonable expenses for the Motion for Sanctions and Motion to Strike after review of the parties' supplemental submissions.

Link Order on Motion to Amend/Correct
EO: The Court has received Plaintiffs' 39 Revised Motion to Amend Name of Defendant and Complaint (Revised Motion), which replaces Plaintiffs' previously filed 36 Motion to Amend Name of Defendant and Complaint. Accordingly, the Court TERMINATES Plaintiffs' previously filed 36 Motion.
Regarding Plaintiffs' 39 Revised Motion, the Court must DENY this motion because Plaintiffs have incorrectly identified Defendant "GREAT SILK RD TRANSPORTATION INC" by adding a period to the end of the "INC." Compare Pls.' Status Report, ECF Nos. 18-8 and 18-9, Exhibits 2-H and 2-I (identifying the name as "GREAT SILK RD TRANSPORTATION INC" (with no period after "INC") in Defendant's business registration and Certificate of Formation) with Pls.' proposed amended complaint, ECF No. 39-2 (identifying the name as "Great Silk Rd Transportation Inc." with a period). Accordingly, by no later than 5/24/2024, Plaintiffs may file a new motion correctly identifying Defendant "Great Silk Rd Transportation Inc". Plaintiffs shall attach both the proposed amended complaint and a redline showing changes between the original Complaint.
