   MINUTE entry before the Honorable John Robert Blakey: Plaintiff filed a second amended complaint on 6/25/25, see 47 , and has moved for default judgment on that complaint several times. But Plaintiff has never demonstrated that it served Defendant consistent with Rule 4. Plaintiff argues that Defendant previously appeared and knows about the case, but Rule 4's service requirement "is not satisfied merely because the defendant is aware that he has been named in a lawsuit or has received a copy of the summons and the complaint." United States v. Ligas, 549 F.3d 497, 50001 (7th Cir. 2008). The Seventh Circuit has emphasized that default judgment "is a weapon of last resort, appropriate only when a party willfully disregards pending litigation." Sun v. Bd. of Trs. of Univ. of IL, 473 F.3d 799, 811 (7th Cir. 2007). And proper service remains a predicate finding to such willful disregard. Having apparently struggled to effect service in compliance with Rule 4, Plaintiff now seeks leave to serve Defendant via alternative means, via electronic mail and publication, see 109 ; the Court grants Plaintiff's motion to this extent. Plaintiff shall effect service as proposed, and, if Defendant still fails to answer or otherwise appear in response to such proper service, Plaintiff may renew its motion for default judgment.
