ORDER RE: 61 Plaintiffs Motion to Revive Judgment: The motion does not include proof that Plaintiff served proper notice of the motion on Defendant(s). Under Federal Rule of Civil Procedure 69(a)(1), Illinois procedure governs proceedings to enforce a money judgment unless a federal statute provides otherwise. Illinois law requires service of notice of a petition to revive judgment in accordance with Illinois Supreme Court Rule 106, which incorporates the notice methods provided in Illinois Supreme Court Rule 105. See 735 ILCS 5/2-1602(c). On or before July 28, 2026, Plaintiff shall file proof of service showing compliance with Rules 106 and 105. The Court will not consider the motion until proper service is shown and the response period has expired. Failure to comply may result in denial of the motion without prejudice.
