ORDER: Magistrate status//Discovery management conference hearing held. By agreement of all parties present, the Court held an off-the-record discovery management conference. As to the parties' proposed use of a TAR protocol, the Court expressed its general practices and views of TAR-related discovery agreements, noting that court-approved protocols are binding on the parties as a matter of course, but agreements between the parties do not necessarily bind the court if discovery disputes arise related to the parties-only agreement. Status hearing set for 5/31/24 at 10:30 a.m. Court may need to reset the hearing if its other judicial obligations interfere. Joint status report due by noon on 5/29/24 regarding issues discussed today. Court will not set a discovery schedule as to counterclaim at this time. Joint Status Report should include: status of any agreement/disagreement regarding search terms; status of any agreement/disagreement regarding laptop and cell phone searches; proposed discovery schedule(s); parties' views on discovery as to L2's counterclaim; any other issues counsel wish to address with the Court. (For further details see order.) Signed by the Honorable M. David Weisman on 5/7/2024. Mailed notice (ao, ) (Entered: 05/09/2024)
