The Parties should be prepared to: (1) summarize the Supreme Court's recent decision in Durnell; (2) discuss how that decision affects this case; and (3) outline prospective options moving forward. The Court is not inclined to continue trial or substantial alter any deadlines at this juncture. However, it would like to hear from both parties and work collaboratively, under Federal Rule of Civil Procedure 1, to achieve the most economic outcome.
