MINUTE entry before the Honorable Sunil R. Harjani: The DPPs and Defendant Butterball are instructed to meet and confer about proposed time limits for trial by 8/28/2026 and submit a joint status report with their joint proposal, including why that amount of time is necessary, by 9/4/2026. A preliminary list of will call witnesses shall also be included and discussed. The total hour limit for each side shall be on-the record time (i.e. opening statements, closing arguments, and all examinations) but does not include any sidebars or off-the-record time. The Court generally resolves any trial issues raised by the parties at a hearing that will last from 8:30 a.m. to 9:00 a.m. every trial day. Sidebars are discouraged and will be held only in extenuating circumstances. The parties should estimate that an on-the-record trial day is 6 hours per day, Monday through Friday. A full trial day, including off-the-record breaks, will run from 9:00 a.m. to 5:00 p.m. The parties are cautioned that this Court will expect the parties to be efficient and move through the testimony smoothly. Excessive repetition or focus on irrelevant issues will not be permitted, and the Court will invoke Federal Rule of Evidence 611 to ensure this does not happen. Thus, the parties shall be realistic and judicious in their request for trial time from the Court. The parties shall do everything possible as well to reach an agreement on this matter.
