FINAL REPORT AND RECOMMENDATION (recommendation found in R&R 87 ) the court RECOMMENDS that Plaintiff's claims against Defendants be DISMISSED with prejudice for want of prosecution, failure to comply with a lawful order of the Court, and as a sanction for discovery violations pursuant to Rule 37 of the Federal Rules of Civil Procedure. The Undersigned RECOMMENDS that Plaintiff's motion to remand 77 also be DENIED. Finally, the undersigned RECOMMENDS that the Court decline to exercise supplemental jurisdiction over Defendants' remaining state counterclaims against Plaintiff, and that the counterclaims be REMANDED to state court along with Defendants' pending motion for summary judgment 84 as to those claims.
