OPINION & ORDER re: 64 MOTION to Dismiss 25 [Third] Amended Complaint. filed by Rachel Tanguay, David M. Ascher, Anna Kosovych, 67 MOTION to Dismiss for Lack of Jurisdiction . filed by Beryl (David) Friedman, Suri (Sarah ) Friedman, Chaim Leibish Rottenberg. For the foregoing reasons, Plaintiff's claims are dismissed with prejudice. Because the Court dismisses Plaintiff's claims in their entirety, Plaintiff's pending application for a temporary restra ining order is denied as moot. The Clerk of Court is respectfully directed to terminate the motions at ECF Nos. 64 and 67, and to terminate the action. The Clerk of Court is further directed to mail a copy of this Opinion & Order to pro se Plaintiff and to show service on the docket. SO ORDERED. ORDER: Plaintiff has failed submit a proposed Case Management Plan or communicate with the Court regarding compliance with the September 11, 2025 Order. Plaintiff has likewise failed to respond to the Court's Order to Show Cause. No lesser sanc tion would be effective in light of Plaintiff's failure to respond to the Court's Order to Show Cause. As Plaintiff has not responded to the Court's Order to Show Cause, the instant action is hereby dismissed for failure to prosecut e pursuant to Federal Rule of Civil Procedure 41(b). The Clerk of the Court is respectfully directed to close the case. The Clerk of Court is also directed to mail a copy of this Order to pro se Plaintiff at the address listed on ECF and to note service on the docket. SO ORDERED.
