PAPERLESS Minute Order for proceedings held before Magistrate Judge Marty Fulgueira Elfenbein: Discovery Status Conference held on 9/11/2026 via Zoom.
The Court heard from the Parties regarding ECF No. 33 . Reasons stated on the record. The Parties agreed to produce their supplemental discovery responses no later than September 17, 2026. No later than September 14, 2026, Defendant will provide dates to Plaintiff for a discovery hearing and the Parties will contact the undersigned's chambers early next week to schedule a hearing. Carnival will provide dates for the deposition of its 30(b)(6) witness no later than September 18, 2026. Plaintiff's deposition did not go forward due logistical issues involving Plaintiff's inability to hear the questions. The Parties have since worked out hearing accommodations for Plaintiff's deposition and Plaintiff has provided dates for the deposition. The Parties are in the process of scheduling the depositions of eight (8) Carnival crew employees and, no later than September 18, 2026, Defendant will either provide their availability or advise Plaintiff that they no longer work for Carnival. Plaintiff also seeks to depose the vessel's captain and other undisclosed bridge officers and Defendant may depose some of Plaintiff's treating physicians. No later than September 18, 2026, Plaintiff and Defendant shall provide one another dates for Plaintiff's CME and Defendant will provide dates for the vessel inspection.<pTotal time in court: 30 minutes.
