ORDER Approving 49 joint Protective Order with the exception of language and procedure concerning Sealing, which is not approved. Any party seeking leave to file under seal with the Court confidential information obtained during pretrial discovery and subject to this Protective Order, must first comply with, apply for, and obtain court permission to file such information under seal, pursuant to N.D.N.Y. L.R. 5.3. Upon the filing of any such application, the Court will make a determination, pursuant to Lugosch v. Pyramid Co. of Onondaga Cnty., 435 F.3d 110, 119-27 (2d Cir. 2006), as to whether a sufficient showing has been made that the interests of parties in preserving the confidentiality of the information at issue sufficiently outweighs the public's interest in access to judicial documents in order to justify the requested sealing.
