   ORDER: The most recent trial order noted that the parties had already filed a Joint Proposed Pretrial Order on September 8, 2025, in anticipation of a previously scheduled trial date and did not restate the requirements for the content of the pretrial order. (See Doc. No. 89 ). The Joint Proposed Pretrial Order (Doc. No. 70 ) does not include a statement of the issues. In addition, the Court notes that although Defendant states in a footnote of damages brief that "the issue of punitive damages, of course, should be bifurcated at trial," no motion for bifurcation has been filed and Defendant's proposed jury instructions and verdict form (Doc. Nos. 68 , 69 ) do not address bifurcation. Accordingly, on or before, August 18, 2026, the parties shall submit a revised Joint Proposed Pretrial Order that includes a statement of the issues, including a designation of which issues are for the jury and which are for the Court. By the same date, Defendant shall confer with Plaintiff regarding the issue of bifurcation and file either a notice advising the Court that the parties agree to bifurcate the issue of punitive damages or, if Plaintiff opposes bifurcation, a motion to bifurcate the trial.
