** TEXT ONLY ORDER ** Plaintiff Jacob Holbert filed this civil action against defendants Kendra Riddle and City of Columbus, Wisconsin. Defendant Riddle has responded with a motion to dismiss for failure to state a claim under Fed. R. Civ. P. 12(b)(6). (Dkt. # 7 .) Plaintiff has now filed an amended complaint (dkt. # 11 ), which supersedes the original. See, e.g., Johnson v. Dossey, 515 F.3d 778, 780 (7th Cir. 2008) ("When an amended complaint is filed, the prior pleading is withdrawn and the amended pleading is controlling."). Therefore, it is ORDERED that the pending motion to dismiss (dkt. # 7 ) is MOOT. Defendant Riddle is free to file a new motion in light of the amended complaint should she continue to believe that plaintiff's claims would not survive a challenge under Fed. R. Civ. P. 12(b)(6).
