Plaintiffs filed a motion seeking to compel production of certain "reports of immoral conduct" that plaintiffs contend defendant Madison Metropolitan School District (MMSD) must make pursuant to Wis. Stat. § 115.31(3). Dkt. 288 . Plaintiffs say they requested the reports in January and accuse MMSD of delay. MMSD avers that it has been diligently looking for the reports and faults plaintiffs for failing to engage in a more thorough meet and confer process. In any event, MMSD now claims that "no responsive documents have been found after an appropriate and diligent search." Dkt. 288 at 8. Neither side is without blame here. Even accepting MMSD's truncated characterization of the timeline, id. at 4, it should not have taken three months to determine that MMSD does not maintain copies of the requested reports. MMSD does not provide a convincing reason for this lengthy delay. On the other hand, plaintiffs could have and should have done more to bring this issue to MMSD's attention more timely, possibly avoiding the need for a motion that now appears (mostly) moot. Although MMSD's briefing notes no responsive documents were found, it must supplement its discovery responses per the rules. For this reason, the court GRANTS the requested relief in part and ORDERS defendant MMSD to supplement its responses to the relevant discovery requests to clarify that no responsive documents were found and to swear those responses under oath. The court otherwise DENIES the motion. Given the conduct discussed above, each side bears its own expenses and fees under Fed. R. Civ. P. 37(a)(5). Signed by Magistrate Judge Anita M.
