MINUTE ENTRY ORDER: Minute entry for MOTION HEARING before Judge Charles Eskridge on May 15, 2024. All parties present and represented by counsel. The Court addressed the motion for summary judgment by Defendant Klein ISD Education Foundation. Dkt 43. The parties were ORDERED to provide by brief letter any further authority regarding whether under Title IX there is a time limit beyond which a school district is no longer obligated to investigate a report. The parties are also here further ORDERED to include any authority pertaining to any obligation under Title IX to undertake any particular investigation or refer such inquiry to any particular administrator, including the school Title IX coordinator. Such supplemental authority must be provided by May 24, 2024. The motion was otherwise TAKEN UNDER ADVISEMENT. The Court addressed settlement. The parties advised that they previously attempted mediation with the Magistrate Judge but without success. Plaintiff was ORDERED to promptly make a settlement demand on Defendant, to which Defendant must respondit being made clear that demand and response are within the discretion of each. The parties must advise by May 28, 2024, if they wished the Court to hold its decision on the motion pending further mediation or settlement discussions. Appearances: Whitney J.
