ORDER RE: THE CITYS MOTION TO DISMISS, GREEN TEAMS MOTION FOR LEAVE TO AMEND, GREEN TEAMS MOTION FOR PARTIAL SUMMARY JUDGMENT; THE CITYS MOTION TO CONTINUE TRIAL AND MODIFY THE SCHEDULING ORDER; AND THE CITY'S EX PARTE APPLICATION TO STAY CASE 24 46 52 61 63 by Judge Cynthia Valenzuela: For the foregoing reasons, the Court ORDERS as follows 1.The Citys Motion to Dismiss (Doc. # 24) is GRANTED IN PART and DENIED IN PART as stated above. 2. Green Teams Motion for Leave (Doc. # 46) is DENIED AS MOOT to the extent it seeks leave to amend Green Teams existing claims; DENIED to the extent it seeks to add a dormant Commerce Clause claim; and DEFERRED to the extent it seeks to join USAgain. 3. Green Teams Motion for Partial Summary Judgment (Doc. # 63) is DENIED WITHOUT PREJUDICE. 4. The Court ORDERS supplemental briefing on the issue of USAgains proposed joinder. a. Green Team may file a supplemental brief addressing USAgains proposed joinder no later than September 30, 2026. The brief shall not exceed ten (10) pages. The City may file a response, not exceeding ten (10) pages, within seven (7) days of that filing. Green Team may file a reply brief, not exceeding five (5) pages, within seven (7) days of the response. b. The supplemental briefs shall address: (a) the claims USAgain would seek to assert in light of this Order; (b) the factual and legal issues common to Green Team and USAgain and those specific to each; (c) the status and potential effect of USAgains other litigation concerning Ordinance No. 187248; and (d) whether joinder would promote judicial economy or instead cause duplication, prejudice, delay, or unnecessary expansion of this action. 5. The Court sua sponte VACATES the trial date and all remaining case deadlines pending resolution of the joinder issue. Accordingly, the Citys Motion to Continue Trial and Modify the Scheduling Order (Doc. # 52) and Ex Parte Application to Stay Case (Doc. # 61) are DENIED AS MOOT. After resolving the joinder issue, the Court will direct the parties to submit proposed deadlines and their availability for trial and will enter a revised case schedule. IT IS SO ORDERED.
