Stipulation and Order
STIPULATION AND ORDER REGARDING CHOICE OF LAW: NOW, THEREFORE, the parties hereby stipulate and agree as follows: 1. California law, excluding conflict of law principles which would result in the application of the laws of another jurisdiction, shall govern the Baughman Parties' defamation and defamation per se claims against Beter in this action, including all issues of liability and damages. 2. This stipulation is without prejudice to the parties' respective positions regarding any procedural matters concerning the defamation claims, which shall continue to be governed by the Federal Rules of Civil Procedure and the Local Rules of the Southern District of New York. The Court, having reviewed the parties' Stipulation Regarding Choice of Law, and good cause appearing therefor, it is hereby: ORDERED that the parties' Stipulation Regarding Choice of Law is APPROVED; and it is further ORDERED that California substantive law shall govern the defamation and defamation per se claim in this action, including all issues of liability and damages arising therefrom.
