   5:23-cv-44Minute entry for proceedings held before Magistrate Judge Diana Song Quiroga. Status Conference held on August 24, 2026. Plaintiff appeared via Zoom through counsel Jorge Alvarez. The Court inquired as to the status of things following Judge Kazens dismissal of Defendant Castilleja from the case (Dkt. No. 150) and Plaintiffs Advisory regarding service of remaining Defendants (Dkt. No. 149). Mr. Alvarez said Plaintiff only needed to file for default judgment. The Court asked about Defendants Samuel and Yemelin Guzman (Mr. Castillejas employers), Defendant Lucio (the former owner of the truck driven by Defendant Lorenzo), and Defendant Olpega Distribuidora. Mr. Alvarez confirms that all of them should be/have been dropped from the case. The Court then asked about Defendant Lorenzo and why the address listed for service was a Sephora in Laredo, TX. Mr. Alvarez noted that was where Lorenzo agreed to be served.As for Defendant Angulo, the Court asked whether he was being served in his individual capacity, or as d/b/a Gati Transport. Mr. Alvarez clarified that he was being sued only in his individual capacity and as a member of Andex LLC. The Court asks Mr. Alvarez to clarify the citizenship of Mr. Angulo (who is listed as a Mexican citizen in Plaintiffs Second Amended Complaint (Dkt. No. 111, 5)).The Court informs Mr. Alvarez that default judgment, if granted, will face two major hurdles: there is no sum certain, and 5th Circuit courts disfavor entry of default against multiple defendants. The Court urges Mr. Alvarez to confer with his client and decide whether it makes sense to pursue this judgment.The Court orders Mr. Alvarez to file an advisory by next Monday, August 31, 2026. In that advisory, Mr. Alvarez must tell the Court: whether he wishes to move against Defendants Lorenzo, Angulo, and Andex; confirm the citizenship of Defendant Angulo; and clean up the status of other Defendants (Lucio, the Guzmans, Olpega).Appearances: Jorge Alvarez f/PLAINTIFF; N/A f/DEFENDANT.
