Order on Motion for Extension of Time Order on Motion for Leave Order on Motion for Extension of Time to Answer a Complaint/Petition
ORDER: The Motion for Extension of Time for Defendants the Grand Aerie and Fraternal Order of Eagles and Michael Simonds 23 to file an answer or responsive pleading to August 5, 2026, is granted. Plaintiff objects to the motion, in part, based on Simonds' purported tardiness in responding to the summons. But as evidenced in the June 5, 2026 email from defendants' counsel to plaintiff, defendants provided waivers of service to plaintiff and asked her to file them with the court or, alternatively, asked plaintiff to stipulate to a 60-day extension to appear and respond to the complaint. This request was reasonable, and in fact, a request for such courtesies is normal in the course of federal litigation. Therefore, the motion for extension 23 is granted. In response to the motion, plaintiff asks the court to allocate the reasonable costs of service to defendants. That motion is denied. Pursuant to Local Rule 7-1(b), "[m]otions may not be combined with any response, reply, or other pleading."
Separately, plaintiff has filed a Motion for Leave to File Response to ECF 38 Out of Time 40 . Plaintiff seeks an extension until September 4, 2026, to file a response to the Motion to Dismiss 38 filed by defendants the Grand Aerie and Fraternal Order of Eagles and Simonds. These defendants do not object as long as they have 14 days after the response is filed to file a reply. Again, such courtesies are routinely agreed to in federal court. Defendant Stark has indicated that he opposes this extension, but this motion for extension does not pertain to a motion that he filed. Because plaintiff has shown good cause for the extension, the motion 40 is granted.
Finally, plaintiff has filed a Motion for Leave to File Late Response to Defendant Stark's Motion to Dismiss 35 . Stark did not file a written response. Therefore, the motion is granted. Ordered by Magistrate Judge Youlee Yim You. (pvh)
