MINUTES (IN CHAMBERS) by Judge Mark C. Scarsi: ORDER DENYING EX PARTE APPLICATION 58 AND MOTION TO COMPEL 57 . Plaintiffs Robert Berman, individually and in his capacity as trustee of The Robert Berman Living Trust, and Stacy Berman apply ex parte for an order extending the non-expert discovery deadline. In particular, Plaintiffs ask the Court to issue an order allowing their currently pending motion to compel the depositions of Dan Krause and Mark Schwamberger to be heard after the discovery cut-off and, if Magistrate Judge Charles F. Eick grants the motion, to allow Plaintiffs to take the two depositions after the discovery deadline. (Id.; see Mot. to Compel, ECF No. 57.) Defendant State Farm General Insurance Company opposes the application. (Opp'n, ECF No. 59.) The application is denied. The Court vacates the reference of the motion to compel the depositions to Magistrate Judge Eick and denies the motion as untimely. (lc)
