Parties are present. The Court makes preliminary remarks re Receivers: 993 Emergency Motion for an Order in Aid of Receivership Enjoining Related Inappropriate Contact Between Receivership Defendants and J&J Investors and the potential conflict of interest as it relates to several clawback defendants.
ECF 1027 Receiver's Motion for Leave to File Excess Pages re 1025 Reply is Granted.
The Court addresses the conflict of interest. The witnesses are excused from the courtroom and the following individuals are sworn and examined:
Jordan Judd, Kennedy Mullen, Parker Judd, Gary Judd, Emily Rowland Newberry. Defense exhibit A is marked and admitted.
The Court will not need Preston Judd's testimony. The Court will allow the opportunity for Mr. Marsh to file supplement of written waiver to Mr. Anderson being hired to represent Mr. Judd.
The Court makes findings on the record and is inclined to impose Rule 11 sanctions. The Court will give Mr. Marsh the opportunity to respond to file a written opposition or an explanation as to why sanctions shouldn't be imposed by Friday, October 2, 2026 at noon.
Proceedings recess from 11:46 a.m. - 11:58 a.m.
An order shall follow that will require that there be no communication that would constitute interference between the defendants in the 2:22-cv-612-CDS-EJY and the clawback defendants which are in the 2026 cases ending in 990, 993, 995, 996, 997, 998, 1000, 1001. Any missed cases will be included in the order.
Further, the Court will take under advisement the filings that are made in the clawback actions that are associated with JFA organization.
Further, order shall follow as to ECF No. 88 in this action 2:22-cv-0612-CDS-EJY and all the clawback defendants. The Court will issue order directing compliance with ECF No. 88 .
Further, the Court will issue an order as to ECF No. [1031 through 1036].
The Court orders that only individuals who work for the Government or individuals who are attorneys who need to appear by Zoom for whatever reason and are barred attorneys and who can certify that they are, in fact, who they are are able to appear by ZOOM video conference.
The Court will allow individuals to appear via Zoom on a case by case basis depending on whether or not the Court can verify that they are who they are. If the individual(s) are allowed to appear via Zoom for purposes of hearings in this action or any collateral clawback actions, then they are precluded, prohibited, enjoined from, ordered that they cannot share that Zoom information with any other individual. Permission will be solely for that person.
