ORDER Microsofts Motion to Stay Discovery and for Reconsideration (Doc. 84 ) is GRANTED. IT IS FURTHER ORDERED that all merits discovery is STAYED pending further order of the Court. The stay does not alter either party's duty to preserve potentially relevant evidence or comply with existing confidentiality and other obligations. IT IS FURTHER ORDERED that, upon reconsideration, the Court REVERSES the conclusion in its March 31, 2025 Order (Doc. 42 ) that the asserted claims are not directed to abstract subject matter. The Court finds that the asserted claims are directed to an abstract idea at Alice step one. The Court reserves ruling on whether the asserted claims contain an inventive concept under Alice step two and therefore reserves ruling on the ultimate disposition of dismissal under 35 U.S.C. § 101. IT IS FURTHER ORDERED that LTI may file a supplemental brief, not to exceed 15 pages, addressing only Alice step two within 30 days of the date of this Order. Microsoft may file a responsive supplemental brief, not to exceed 15 pages, within 30 days after service of LTIs brief. LTI may file a reply, not to exceed 8 pages, within 21 days after service of Microsoft's response. IT IS FURTHER ORDERED that the Parties' Joint Motion for Markman Hearing (Doc. 87 ) is DENIED WITHOUT PREJUDICE pending the Court's final decision on patent eligibility.
