ORDER: IT IS ORDERED that by no later than October 5, 2026, ASARCO must SHOW CAUSE in writing why its claims should not be dismissed for lack of subject matter jurisdiction. IT IS FURTHER ORDERED that alternatively, by no later than October 5, 2026, ASARCO may either (i) file a First Amended Complaint that contains allegations addressing subject matter jurisdiction and the issues identified in this Order; or (ii) voluntarily dismiss its claims without prejudice.
