The Court heard from the parties on the Motion to Compel with respect to the Dark Web information.
Plaintiff agreed to provide Defendants with a description of the services reviewed and the method used to gather the documents. The parties agreed that no further ruling was necessary.
With respect to the Motion to Compel regarding spam, the parties agreed to confer in an effort to reach a stipulation between Plaintiffs and the TIAA/Genworth Defendants regarding Plaintiffs position with respect to spam. The parties are to report to the Court by close of business on Wednesday, September 16, 2026, whether an agreement has been reached for a stipulation.
The parties conferred pursuant to a Rule 37.1 conference regarding privilege issues between Plaintiffs and Progress.
Plaintiff is to submit a brief by close of business on September 16, 2026, setting forth Plaintiffs position regarding the legal issues concerning the privilege claim. Defendants are to respond by September 28, 2026.
