Order on Motion to Amend/Correct ~Util - Set/Reset Deadlines
TEXT ORDER: The parties' 58 Joint Motion to Amend/Correct, which the Court construes as a request to modify the discovery schedule, is GRANTED. Under Fed. R. Civ. P. 16(b)(4), a scheduling order "may be modified only for good cause and with the judge's consent." The parties request an extension because Plaintiff and Defendant Board of Education for East Peoria Community School District No. 309 have agreed to private mediation, for which the earliest date available is after the close of fact discovery. Defendants City of East Peoria and David Roos are not participants in the mediation, but have agreed to the extension, as a successful mediation may affect the scope of the remaining discovery. The Court finds good cause for the requested extension. Accordingly, the discovery schedule is now as follows: (1) Fact discovery shall be completed by December 9, 2026; (2) Plaintiff shall disclose experts and expert reports by January 6, 2027; (3) Plaintiff's experts shall be deposed by February 10, 2027; (4) Defendants shall disclose experts and expert reports by March 10, 2027; (5) Defendants' experts shall be deposed by April 7, 2027; (6) All discovery shall be completed by April 7, 2027; and (7) Dispositive motions are due by May 12, 2027.
