~Util - Set/Reset Deadlines/Hearings Status Hearing - Pre-Motion Discovery Dispute
Minute Entry for proceedings held before Magistrate Judge Ronald L. Hanna: Discovery-dispute hearing held. Plaintiff appeared by Attorney Rachel Katz. Defendants appeared by Attorney John Swinney. The parties stated their respective positions regarding whether the Rock Island-Milan School District No. 41 and the Rock Island Board of Education should be treated as separate parties under the numerical limit on interrogatories in Federal Rule of Civil Procedure 33(a)(1). The Court declined to decide that issue. After discussing the burden of responding, the Court advised the parties that, based on the present record and without prejudging any future motion, it would be inclined to grant Plaintiff leave to serve the disputed interrogatories, considering the circumstances of the case as a whole, including Plaintiffs reasonable reliance on the existence of two named Defendants when structuring discovery. The parties are directed to promptly meet and confer again in light of the Courts guidance. If the dispute remains unresolved, Plaintiff may file a motion to compel, which will be subject to the expense-shifting provisions of Rule 37(a)(5). Further status conference set for September 8, 2026, at 2:00 P.M. by Zoom. Participants shall use Meeting ID 160 958 93703. Telephone participants shall call (551) 285-1373 and enter the Meeting ID. If the dispute is resolved before the conference, the parties shall file a short joint statement notifying the Court and requesting that the conference be vacated. (Tape #PR-D: 11:00am.) (AEJ)
