Under Rule 41, a plaintiff may voluntarily dismiss an action by filing "a stipulation of dismissal signed by all parties who have appeared." Fed. R. Civ. P. 41(a)(1)(A)(ii). Once such a stipulation is properly filed, no court order is necessary to effectuate the dismissal; therefore, this case is terminated.

Before the Court is Mr. Morgan's Notice regarding his upcoming deposition. Mr. Morgan is reminded that if he seeks relief of any kind from the Court he must file a motion not a notice. Nonetheless, it appears Mr. Morgan is prepared to appear for his October 6, 2026 deposition by videoconference. While the Court is sympathetic to the desire for an in-person process, reason counsels that to achieve the goal of obtaining Mr. Morgan's deposition it will need to proceed by videoconference.
Accordingly, Mr. Morgan's October 6, 2026 deposition will proceed by videoconference. Mr. Morgan must appear and cooperate throughout the deposition. He must answer questions to the best of his recollection. Objections based on relevance are not generally appropriate. Mr. Morgan must arrange to be in a private location. The space must be enclosed with no one else present. Mr. Morgan must ensure he has stable and reliable internet. The parties may test the connection on Monday, October 5, 2026, if they so choose. No one is to provide assistance to Mr. Morgan when answering questions posed. If Mr. Morgan consults with anyone during a break, he will have to disclose with whom he spoke and the subject matters discussed. Mr. Morgan may not use artificial intelligence at any time during the deposition. If difficulty arises during the deposition, the parties are to call chambers for the undersigned (702-464-5580) to obtain assistance.
