MEMORANDUM ORDER - (Granting Motion for Leave to File Sur-Reply; Granting Motion to Dismiss) - The Court hereby GRANTS Plaintiff's Motion for Leave to File Sur-Reply (ECF No. 9 ), GRANTS Defendants' Motion to Dismiss (ECF No. 4 ) and DISMISSES WITHOUT PREJUDICE this action for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). The Court further concludes that further amendment would be futile, as the Court sees no reason why further amendment would correct the fundamental deficiencies discussed herein. As the Court does not grant leave to amend, this Order qualifies as final and appealable. Should Plaintiff desire to appeal, written notice of appeal must be filed with the Clerk of the Court within thirty (30) days of the date of entry hereof. Failure to file a notice of appeal within that period may result in the loss of the right to appeal. This case is now CLOSED. It is so ORDERED. SEE ORDER FOR FULL DETAILS.
