EO: The Court reviewed Plaintiffs Karlo L.G. Tanjuakio and Keith Rodriguez's (Plaintiffs) 91 Further Status Report. The Further Status Report states that "Plaintiffs are intending to pursue filing and service of a First Amended Complaint[.]" ECF No. 91 . Plaintiffs made this same statement in their June 5, 2026 Status Report. See ECF No. 79 ("Plaintiffs are intending to pursue filing and service of a First Amended Complaint[.]"). To date, no First Amended Complaint (FAC) has been filed.
Therefore, the Court directs Plaintiffs to file a Further Status Report no later than 7/17/2026. This Further Status Report shall state the date by which Plaintiffs will be submitting a stipulation to file the FAC or filing a motion for leave to file the FAC. See Fed. R. Civ. P. 15(a)(2). Plaintiffs are cautioned to comply with Local Rule 10.4. See Local Rule 10.4 ("A motion or stipulation to amend a pleading shall be accompanied by the proposed amended pleading in redline format, which must indicate in every respect how the proposed amended pleading differs from the pleading which it amends, by striking through the text to be deleted and underlining the text to be added.").
Regarding Defendant Travis Palmer, Plaintiffs shall file proof of service on the docket no later than 7/17/2026. See Fed. R. Civ. P. 4(l) ("proof of service must be made to the court").
Lastly, in light of the pending motions to dismiss, ECF Nos. 36 and 39 , the Court CONTINUES the Telephonic Rule 16 Scheduling Conference from 8/4/2026 to 9/29/2026 at 8:30 a.m. before MAGISTRATE JUDGE WES REBER PORTER via Zoom: Dial in number: 1-833-568-8864; Meeting ID: 161 0084 2470.
