Order on Motion to Dismiss for Failure to State a Claim
Now before the Court is Defendants' Motion to Dismiss [Doc. 15]. In response to the motion, Plaintiffs filed an Amended Complaint [Doc. 22]. They assert that their Amended Complaint addresses "Defendants' purported concerns with the [C]omplaint including adding a substantial quantity of additional detail" [Doc. 23 p. 1]. Defendants did not file a reply brief. The Court therefore DENIES AS MOOT Defendants' motion [Doc. 15]. See Crawford v. Tilley, 15 F.4th 752, 759 (6th Cir. 2021) ("The general rule is that filing an amended complaint moots pending motions to dismiss." (collecting cases)). Signed by Magistrate Judge Debra C. Poplin on 5/13/2024. (This entry constitutes the complete Order of the Court.) (AGA)
