PAPERLESS ORDER. THIS CAUSE came before the Court upon Lead Plaintiff's and Defendants' Agreed Motion for an Order Adopting Coordinated Amendment and Briefing Schedule and Discovery Stay. 681 . Therein, Lead Plaintiff Nir Lahav ("Lead Plaintiff") and Defendants Binance Holdings Limited, BAM Trading Services Inc., BAM Management US Holdings Inc., and Changpeng Zhao (collectively, "Defendants") request that, for Lahav et al. v. Binance Holdings Limited et al., No. 1:24-cv-21421-KMM, the Court enter: "(1) a coordinated schedule for Lead Plaintiff to amend the Complaint and Defendants to respond; and (2) a discovery stay." Id. at 1. UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 681 is GRANTED.
The following agreed-upon amendment and briefing schedule shall be adopted: (1) Lead Plaintiff shall elect to proceed with the existing Complaint or file an amended consolidated complaint by May 21, 2024. (2) Defendants shall respond to the Complaint or any amended consolidated complaint on or before July 24, 2024. (3) If Defendants file a motion or motions to dismiss, Lead Plaintiff shall file any opposition brief(s) and any response to Defendants' filings on or before September 26, 2024. (4) Defendants shall file any reply brief(s) in support of their motion(s) on or before October 30, 2024.
The agreed-upon discovery stay shall also be adopted. Pursuant to 15 U.S.C. §§ 77z-1(b)(1) and 78u-4(b)(3)(B), the Private Securities Litigation Reform Act ("PSLRA") automatic stay of discovery shall remain in place during the pendency of any motions to dismiss.
